1. Acceptance of Terms

By accessing or using the AgarwoodsNFT platform, including the website at agarwoodsnft.io and the game at play.agarwoodsnft.io (collectively, the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Platform.

2. Nature of the Platform

AgarwoodsNFT is an online game built on the WAX blockchain. It is a gaming and entertainment platform only. AgarwoodsNFT is not a financial service, investment platform, exchange, or money transmission service. Nothing on the Platform should be interpreted as financial advice or an investment opportunity.

3. No Investment — No Guaranteed Returns

$AGAR tokens and any NFTs associated with AgarwoodsNFT are in-game utility items only. They are not securities, commodities, or financial instruments. There is no promise, guarantee, or expectation of profit or financial return from holding, earning, or using $AGAR tokens or AgarwoodsNFT NFTs. Any market value that may exist is entirely driven by third-party markets and is beyond the control of AgarwoodsNFT.

4. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to use this Platform. If you are under the required age, you may only use the Platform with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

5. User Responsibilities

As a user of AgarwoodsNFT, you are responsible for:

  • Maintaining the security of your WAX wallet and private keys. AgarwoodsNFT will never ask for your private keys.
  • Understanding the risks associated with blockchain technology, including but not limited to smart contract vulnerabilities and network congestion.
  • Complying with all applicable laws and regulations in your jurisdiction, including tax obligations related to digital assets.
  • Any transactions you make on third-party platforms (e.g., AtomicHub, NeftyBlocks, Alcor Exchange).

6. Intellectual Property

All content on the Platform, including but not limited to graphics, artwork, logos, game mechanics, code, and text, is the intellectual property of AgarwoodsNFT and is protected by applicable copyright and trademark laws. Ownership of an NFT grants you a limited, personal, non-commercial license to display the associated artwork. It does not grant you ownership of the underlying intellectual property.

7. Prohibited Conduct

You agree not to:

  • Use bots, scripts, or automated tools to interact with the Platform unless explicitly authorized.
  • Exploit bugs, glitches, or vulnerabilities in the game. Any discovered exploits should be reported immediately.
  • Engage in fraud, deception, or any form of market manipulation.
  • Harass, threaten, or abuse other players or team members.
  • Misrepresent $AGAR tokens or AgarwoodsNFT NFTs as investment products or securities.
  • Use the Platform for money laundering or any illegal activity.

8. Game Changes & Service Availability

AgarwoodsNFT reserves the right to modify, update, suspend, or discontinue any aspect of the Platform at any time without prior notice. This includes but is not limited to game mechanics, token emission rates, NFT attributes, smart contracts, and any features or services. We are not liable for any loss resulting from such changes.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. AgarwoodsNFT does not warrant that the Platform will be uninterrupted, error-free, or secure. We make no guarantees regarding the value, utility, or functionality of any in-game assets, tokens, or NFTs.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AgarwoodsNFT, its developers, team members, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. This includes but is not limited to loss of tokens, NFTs, wallet access, data, or any financial losses.

11. Indemnification

You agree to defend, indemnify, and hold harmless AgarwoodsNFT, its developers, team members, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Platform or violation of these Terms.

12. Privacy

AgarwoodsNFT does not collect personal data beyond what is publicly available on the blockchain. Your WAX wallet address and on-chain activity are public by nature of the blockchain. We do not store passwords, private keys, or personal identification information.

13. Third-Party Services

The Platform may integrate with or link to third-party services such as AtomicHub, NeftyBlocks, WaxDAO, Alcor Exchange, and WAX Cloud Wallet. AgarwoodsNFT is not responsible for the content, policies, or practices of these external platforms. Your use of third-party services is at your own risk and subject to their respective terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or the use of the Platform shall first be resolved through good-faith mediation. If mediation fails, the dispute shall be submitted to the appropriate courts in the Philippines.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Modifications to Terms

AgarwoodsNFT reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
